Good Morning Councillor
Following yesterday's meeting at the premises and further engagement I would like to give you an update.
West Yorkshire Police and Environmental Protection Team both objected to the TEN which was submitted by the operator at the premises for this weekend the 17th and 18th May.
As the TEN was a late TEN, the authorisation was rejected and a counter notice served.
WYP/EPT/Licensing at the premises to discuss the issues with the operator. They have been advised that the TEN at the weekend cannot go ahead.
Officers discussed the previous complaints which have been received on a regular basis over the last few weekends and the impact the noise and disturbance is having on local residents.
EPT will be issuing a noise abatement notice under Environmental Protection Act 1990 to operate.
The operator still states no alcohol sales have taken place at the premises, anyone attending the premises bring their own.
WYP have been requested to pay passing attention to the premises over this coming weekend 17th/18th May, given that the operator has blatantly disregarded agencies engagement over the last few weeks and continued to hold events in the outdoor area.
NPT have been requested to record any footage of the visit on body worn cameras.
The operator asked if they could hold an event at the weekend without any music or licensable activities, she has been strongly advised not to hold any kind of event given the disturbance which has been caused over previous weekends.
However, should they decide to hold any kind of private party where guests bring their own alcohol, unfortunately under the Licensing Act 2003, there wouldn’t be any action I would be able to take.
The operator still insists that they will be submitting a premises licence application, they have been advised that should they continue with their application, it will more than likely attract representations from agencies and residents.
